Conservative Leader Pierre Poilievre wants the government to amend the Criminal Code to clarify that using force to defend your home is presumed to be reasonable if someone breaks in.
During a press conference in Brampton, Ont., he stated that if the government does not make this change, his party will introduce a private member’s bill this fall to do so.
This announcement follows an incident in Lindsay, Ont., where a 44-year-old man was charged with assault after getting into an altercation with a man who allegedly broke into his apartment with a crossbow.
The alleged intruder, a 41-year-old man also from Lindsay, was airlifted to a Toronto hospital with life-threatening injuries.
The chief of the Kawartha Lakes Police Service has defended the assault charge against the victim, saying that a defensive action must be proportionate to the threat faced.
The Criminal Code currently states that a person is allowed to defend themselves during a break-in as long as the force used is “reasonable in the circumstances.”
