The Canada Industrial Relations Board (CIRB) has rejected an argument made by the Canada Post employees’ Union that the government’s order to return to work was unconstitutional.
In December 2024, the federal Labour Minister used her authority under a section of the Canada Labour Code to direct the CIRB to end the postal workers’ strike and take the dispute’s arbitration into its own hands.
The Canadian Union of Postal Workers (CUPW) had argued that the use of Section 107 to forcibly end the strike was unconstitutional. The Union claimed it violated striking workers’ Charter rights to free expression, free association, and life, liberty and security of the person.
In a hearing decision, the CIRB found that the right to strike is “essential” but is not “absolute.” One member of the three-member board expressed dissent on the ruling.
The Union has also filed an application for judicial review, but the Federal Court has not yet issued a decision.
