A B.C. doctor has been acquitted of sexually assaulting a female patient, according to a recent court ruling.
Dr. Olumuyiwa Bamgbade, a pain management specialist, was found not guilty of one count of sexual assault last week following a judge-alone trial in Surrey provincial court.
The patient, whose identity is protected by a publication ban, alleged that during a July 2022 appointment, Bamgbade kissed her and touched her breasts.
At the time, Bamgbade was under a restriction prohibiting him from treating female patients without a chaperone approved by the B.C. College of Physicians and Surgeons. The patient testified, however, that she had been alone with the doctor when the alleged assault occurred.
In his defence, Bamgbade argued the allegations were fabricated, claiming the patient was seeking drugs and that he had refused to prescribe additional medication.
The judge ultimately found the allegations unproven, citing insufficient evidence and inconsistencies in the patient’s account. The decision stated that her description of the alleged touching and kissing was incompatible with the layout of the examination room, and that her testimony contained “material inconsistencies and improbabilities.”
“As a result, I am left with a reasonable doubt that Dr. Bamgbade committed this offence. I find Dr. Bamgbade not guilty,” the ruling concluded.
