A class action lawsuit has been launched against Air Transat by passengers who claim the airline unfairly raised its prices during Air Canada’s flight attendant strike.
The lead plaintiff, who filed the case on Thursday, says she and her husband were stranded in Barcelona during the labour dispute in mid-August. They had originally purchased two round-trip tickets from Montreal to Barcelona via Rome with Air Canada for $2,784.62.
After their Air Canada flight was cancelled on August 14, the couple booked two one-way tickets home with Air Transat for August 16. The tickets cost $5,355.52. They said they had no choice but to pay because they urgently needed to return to Canada to access their medication.
The court filing argues that no reasonable traveler would normally pay that much to fly with Air Transat, and that the airline knowingly exploited stranded passengers by charging excessive fares. It also claims Air Transat’s aircraft are of lower quality than Air Canada’s, pointing out that they lack Wi-Fi and are less comfortable.
Law firms LPC Avocats and Renno Vathilakis Inc. are representing the plaintiffs. They allege Air Transat treated the Air Canada strike as an opportunity to maximize profits, despite its operating costs not increasing.
The lawsuit seeks compensation for all passengers who, since August 14, 2025, paid “inflated or excessive” prices on Air Transat compared to the airline’s usual rates for similar routes. The plaintiffs are asking for damages, interest, and legal costs.
Air Transat has acknowledged the class action but declined to comment since the matter is before the courts.
Meanwhile, LPC Avocats has also filed a separate class action request against Air Canada, accusing it of misleading customers about refunds. The filing says Air Canada pushed passengers to accept travel credits instead of cash refunds, while failing to provide rebooking on the next available flight or alternative travel as legally required.
