B.C. woman receives $5,000 after ex-partner allegedly shares private image

A woman in B.C. has been awarded $5,000 after claiming her ex-partner shared an intimate photo of her without consent.

The applicant, identified only as DH, told the B.C. Civil Resolution Tribunal (CRT) that she had sent intimate photos to her ex, referred to as IR, during their relationship, and that he secretly recorded one video. She said that after their breakup, IR threatened to share the images and later sent a photo to another person, referred to as RP.

Under B.C.’s Intimate Images Protection Act, the tribunal can order individuals who share or threaten to share intimate images without consent to pay up to $5,000.

Tribunal Member Maria Montgomery noted that DH had applied for multiple protection orders regarding the images, with separate decisions issued that are not publicly posted. In her unpublished ruling, Montgomery confirmed the images were intimate as defined by the law and that IR shared one without DH’s consent. She also acknowledged DH’s fear that IR might share additional images in the future.

Although DH did not specify a damages amount, the tribunal pointed out that most awards in Canada for non-consensual sharing of intimate images are higher than the CRT’s $5,000 limit. Montgomery ruled the maximum award was appropriate due to the mental distress caused.

“I accept that she has suffered some psychological distress from the respondent threatening to share and sharing her images,” Montgomery wrote. “IR violated DH’s reasonable expectation of privacy by sharing at least one image and by recording her without her knowledge while they were intimate, as well as threatening to share other images he possesses.”
