Alberta government challenges injunction blocking transgender health-care law

Alberta is appealing a temporary court order that blocks a law prohibiting doctors from providing gender-affirming care to minors. 

In June, a judge found that the legislation raises significant Charter concerns that should be addressed in an ongoing court challenge. Court of King’s Bench Justice Allison Kuntz ruled the law is likely to cause irreparable harm to gender-diverse youth, and the evidence provided by the province was not strong enough to outweigh that risk. 

The provincial government argues the injunction was premature because the law has not yet taken full effect, and says the judge erred in concluding it would cause irreparable harm. It maintains the law was designed to protect children from making potentially irreversible decisions about their bodies. 

Egale Canada, one of the groups challenging the legislation, says it respects the province’s right to appeal but believes the judge’s ruling was correct.
