The Competition Bureau announced on Tuesday that it has secured a court order to advance its investigation into Amazon Canada, aiming to determine whether the company is abusing its dominant position under the Competition Act.
The inquiry focuses on Amazon’s Marketplace Fair Pricing Policy, which allows the company to penalize sellers who price products on Amazon.ca significantly higher than recent prices offered on Amazon or other platforms, according to the bureau’s press release.
The investigation seeks to find out if this policy restricts competitors’ entry or growth by preventing sellers from offering lower prices outside of Amazon. Additionally, the bureau wants to assess whether the policy enables Amazon to charge sellers higher fees than it otherwise would, potentially leading sellers to increase retail prices for customers.
In response, an Amazon spokesperson told CTV News that the company’s tools are intended to help customers make informed purchase decisions and maintain their trust, while supporting thousands of Canadian businesses selling through Amazon.
The Federal Court order mandates Amazon to provide records and information relevant to the investigation, and the company has agreed to cooperate with the bureau. The bureau emphasized that there is currently no finding of wrongdoing.
